All services provided by Creatively Olivia LLC are subject to the following terms and conditions that serves as a legal binding contract, in addition to a signed contract for select services, between the client and Creatively Olivia LLC. The terms and conditions are to protect both Creatively Olivia LLC and the client. By accepting a quote in writing, verbally or by payment, you confirm that you are in agreement. All work is carried out by Creatively Olivia LLC on the understanding that the client has agreed to the following terms and conditions. 

Ownership

You, the client, have ownership of the final design for use in any media application that is beneficial to your business. Creatively Olivia LLC retains the right to use the final design, or any versions of the design created in the process, within printed and online portfolios, including promotional materials such as newsletters and advertisements. The client also gives Creatively Olivia LLC permission to use client’s full name, business address, and/or website address, for testimonial purposes on her website, or other business related media. The client understands that it is the client’s responsibility to copyright the design (www.copyright.gov) and/or seek trademark (www.uspto.gov/main/trademarks.htm).

Payments

Services under $500 require full payment up front. The client will make a 50 percent down payment for services over $500  prior to work commencing. The project can be scheduled once Creatively Olivia LLC receives payment. The down payment is non-refundable. The remaining 50 percent is payable to the designer upon completion of the project, and before original artwork is supplied to the client.

Overdue Payments

If, after the project has commenced, subsequent invoices are not paid within 15 days, Creatively Olivia LLC has the right to remove any website or online material and services provided or maintained. Creatively Olivia LLC will not be held responsible for any inconveniences caused by removing any online material or services.  Any future projects with the client will require full payment in advance.

Refunds & Cancellation

If after project commencement client communication (face-to-face, telephone, or email) stops for a period of 180 days, the project can be canceled, in writing by the designer, and ownership of all copyrights shall be retained by the designer. Creatively Olivia LLC reserves the right to retain down payments or any other payments as the cancellation fees. Refunds are not permitted unless explicitly agreed upon.

Design Drafts

Draft images are for viewing for approval only. They may not be copied, edited, or distributed to any other person or company, other than those directly involved with the project without prior permission from Creatively Olivia LLC. You will receive drafted files with a company watermark attached until the full payment is made.

Project Content

The client agrees to provide all text and pictures required for the completion of any items to be designed. It is expected that all text supplied has been checked for typographical and grammatical errors, and has been approved by the client that will have the final call in the release of any items designed. Additional fees may apply for any necessary photography services, stock photos, media conversions and image editing. The client agrees that advisement may be given and corrections may be made by Creatively Olivia LLC to text and images to improve the design of any items. There will be no additional charges for these suggestions and modifications unless specified, as it is included with any project.

Domain and Hosting

Domain and hosting fees are included in your quote provided for one year. Thereafter, the client is responsible for all renewal fees for hosting and domains.

Confidentiality

The client shall inform the designer in writing before the project commences if any portion of any material or information provided by the client or if any portion of the project is confidential. The client and Creatively Olivia LLC may disclose confidential information to one another in order to facilitate work and payments. The client agrees that he or she may need to provide usernames and passwords in order to upload and edit information. Complete privacy is assured. No username, passwords or email addresses will ever be shared or used for any purpose other than that it was supplied for.

Delays

Illness, injury, or other events beyond Creatively Olivia LLC’s control, such as: fire, theft, computer failure, and Acts of God may result in a delay of unpredictable length. The designer will work hard to inform clients as soon as permitted.

Snapchat GeoFilters

Creatively Olivia LLC is not responsible for the submission of the Snapchat Geofilter to snapchat.com. If there are any errors during submission, such as if the wrong location is tagged, or the payment to run the filter fails, Creatively Olivia LLC is not liable. If the submission is declined for design reasons, please email us as soon as possible. We will work with you to get your filter approved within the allotted amount of time. We recommend allowing 24 – 48 hours for approval though Snapchat does not declare a timeframe. For further assistance, the client can respond to the email received from Snapchat.

A document containing the above terms and conditions will be supplied via email along with the first invoice. Before you confirm your agreement to these terms, please make sure you understand all of the above agreement.
